The entity is authorised to carry out insurance operations in various non-life branches, filed in the Register of Insurers and Reinsurers of the Directorate-General for Insurance and Pension Funds with the code C0124.

Furthermore, SegurCaixa Adeslas has a firm commitment to implement best practices through compliance with Good Practices Guides of the Spanish Union of Insurance Companies (UNESPA), which may be consulted at www.unespa.es

These General Terms and Conditions of Use of the Website, hosted in the domain segurcaixaadeslas.es/en and in the Adeslas Salud y Bienestar App, together with the Privacy Policy regulate access to the Website and use by the Users of the digital services available in SegurCaixa Adeslas’s Customer Private Area of the Website and App, which are indicated in the “Services” section.

Also, take into account that through SegurCaixa Adeslas’s Customer Area of the Website and App, third-party services can be accessed, hence it will be important to remain attentive to the notices that may be shown during browsing. These third parties must provide you with information on the services offered and on the processing of your personal data. In these cases, SegurCaixa Adeslas shall not be liable for the provision of the related services or the concomitant data processing.

 

2. Use of services

  • Users are responsible for ensuring that the information they contribute does not breach third-party rights, or infringe the law, public order or good habits.
  • The Users of SegurCaixa Adeslas’s Customer Private Area and App digital services are responsible for ensuring that the information is not visualised or accessible by unauthorised people.

In particular, all Users are prohibited from:

  • Registering or notifying data that are not true, accurate, complete or up to date. The data must be kept up to date, using the options available through the Customer Private Area or by contacting www.segurcaixaadeslas.es/en/help/contact 
  • Gaining access using the name, ID details or passwords of another User, or supplanting another person or entity.
  • Making unauthorised uses or breaching confidentiality rules. The subsequent use, for commercial purposes, of the services available both on the Website and in is also prohibited.
  • Using services to notify any information or content contrary to the rights of other people, such as, for example, those of a defamatory, aggressive, obscene, sexually explicit, offensive, racist or xenophobic or violent nature or those that incite violence or are illegal in general. 
  • Sending commercial notices that have been requested or not requested, or any other type of advertising by any means (including, without limitation, by email, SMS or by any other means of communication) to any other User of the service or to third parties).
  • The User undertakes not to use the Website, Customer Private Area or App illegally or in any other manner that may damage, deactivate, overload or affect the service or cause harm to SegurCaixa Adeslas and, in particular, not to store, transmit or distribute the following through the company:
    • Any content that breaches third-party intellectual property rights.
    • Viruses, malware, worms, trojans or performing any other type of destructive activity, including denial of service attacks.
    • Performing activities that interrupt or interfere in the effective use of the Website or that prevent Users from browsing on it.
    • Activities that breach personal data protection obligations related to other interested parties, such as appropriation, notification, alteration or destruction of third-party data.
    • Sharing their access codes with third parties.

If these obligations are breached, SegurCaixa Adeslas reserves the right to adopt all appropriate measures to halt these procedures and may, among others, delete or eliminate any content or information that it deems appropriate or suspend, limit or cancel access on a temporary or definitive basis.

Without prejudice to possible procedures commenced by third parties, SegurCaixa Adeslas reserves the right to undertake legal action in its own name to repair the damage caused due to the breaches that may have been attributed to it as a result of a possible use of the Website by a User.

3. Functions/Services

The SegurCaixa Adeslas Website allows general information on our company to be accessed, together with our products available for any User. 

Users that are customers of SegurCaixa Adeslas, through our Website or App, may access the Customer Private Area where they will find information on the insurance policies that they have taken out and they can perform the dealings available at all times for each type of service arranged, as detailed in the following sections:

 

3.1 Digital services for Health insurance customers

The health insurance policy’s digital services will only be available for those people that have taken out SegurCaixa Adeslas’s health insurance policy. These services will be available in the Customer Private Area accessible through the Website or in the App.

In the case of health insurance policies through SegurCaixa Adeslas’s Customer Private Area of the Website or App, common procedures can be carried out such as consulting the Healthcare Provider List, requesting appointments, obtaining telephone or online medical advice, managing authorisations and refunds, etc.

Furthermore, both through SegurCaixa Adeslas’s Customer Private Area of the Website and the App, another type of complementary service can be accessed:

  • Healthy lifestyle programmes and prevention and care programmes based on the information provided by the Users in questionnaires filled in by them voluntarily. The participation of Users in these plans or programmes will also be voluntary and the Users must register for them to take part. 
  • Medical advice and psychoemotional advisory services with professionals in these areas.
  • Informative blog, articles and news on health-related matters.
  • Loyalty-building and promotion programmes. You can consult the information on the programmes currently under way at Information on the loyalty-building programmes currently under way, but remember that to enjoy these advantages, you must participate therein and that they have a validity period so they will not be available on an indefinite basis.

Take into account that during the provision of these services third parties can intervene (especially in the services in which the health professionals are involved). In these cases, the third parties shall be fully responsible for both the services and the processing of personal data These third parties must provide you with information on the services performed and on the processing of your personal data. SegurCaixa Adeslas shall not be liable for the provision of services or the related data processing.

 

Requirements for the use of digital health services

Access to digital health services is limited to people over 18, residing in Spain that are beneficiaries (insured parties) of a health insurance policy with Segurcaixa Adeslas. 

To use the services from the App you must previously download it and register as a User both in the Customer Private Area and in the App. 

Take into account that the digital services available may be different for Policyholder Users than for Insured Party Users given the circumstances of each of them.

 

3.2 Digital services for multibranch insurance customers

In the case of other insurance policies, such as Car, Home, Death, Pet, Accident, Travel Assistance and other insurance policies, through its Customer Private Area, SegurCaixa Adeslas allows procedures to be performed such as the consultation and download of documentation relating to the policy taken out or the online opening of the claim declaration for home and car insurance.

Take into account that during the provision of any of these services third parties can intervene (especially in the services in which the assistance companies are involved). In these cases, the third parties shall be fully responsible for both the services and the processing of personal data These third parties must provide you with information on the services performed and on the processing of your personal data. SegurCaixa Adeslas shall not be liable for the provision of services or the related data processing.

 

4. Access and registration as a User in the customer private area of the website and app

As we have indicated if you are a customer of SegurCaixa, you can enjoy these digital services through SegurCaixa Adeslas’s Customer Private Area of the Website or App, so it is necessary for the User to carry out the registration process during which they will be requested to accept these terms and conditions, be supplied with the information relating to personal data processing and, where appropriate, be requested to provide additional consent to legalise certain processing activities.

The acceptance of these “Terms and Conditions” will link the User during the provision of SegurCaixa Adeslas’s digital services. If you disagree with these Terms and Conditions, please do not make use of the Customer Private Area or the App.

Registration at SegurCaixa Adeslas means that the User must fill in a registration form during which the necessary personal details will be requested:

  • Name, first surname, second surname, number of the insurance policy taken out (or health card number for health insurance policies or registration number for car insurance policies, ID number, date of birth, email and telephone number.

These data will be processed in accordance with that stipulated in the privacy policy.

The data provided by the Users must be true, accurate and correct, and the User is liable for any possible damage that may be caused by the use of false, inaccurate or incorrect data or those that had been provided to SCA without authorisation. It is not permitted to use third-party data.

Through the registration process the User will remain registered until they cancel their policy.

The User undertakes to keep confidential the access codes provided to them or used by them to access SegurCaixa Adeslas’s digital services and to not transfer or notify said codes to third parties. SegurCaixa Adeslas shall not assume any type of liability for any type of incorrect or negligent use of these codes by the User.

If a User suspects that their codes have been subject to unauthorised use, they must contact SegurCaixa Adeslas’s Customer Services department.

SegurCaixa Adeslas reserves the right to refuse to use the Customer Private Area digital services and App at any time without the need to provide advance notice, in the event of a fraudulent use thereof and in the event of a breach of these Terms and Conditions, violation of copyright or intellectual or industrial property and, in general, faced with any infringement of the prevailing legislation applicable at any time or of SegurCaixa Adeslas’s internal policies.

In these cases, access or the User’s account can be temporarily or permanently deactivated.

You can cease to be a Customer of SegurCaixa Adeslas’s Digital Services of the Website or of the App at any time by cancelling your account, which can be done by deregistering from the page clientes.segurcaixaadeslas.es/global/editar-perfil/baja

 

5. Personal data processing

As data controller, at SegurCaixa Adeslas, we shall process your personal data to verify your identity and manage access to use SegurCaixa Adeslas's digital services offered through its digital platforms based on the formalisation of the contract.

Your data will not be transferred to third parties unless a legal obligation exists or in those cases in which it is necessary to correctly provide the service. Likewise, said data may be notified to third parties if you provide us your express consent in this regard.

6. Responsability for the functioning of the website

SegurCaixa Adeslas shall not be liable for any damage or losses arising from (i) interference, omission, interruptions, computer viruses, breakdowns, malfunctioning of the electrical system or apparatuses or IT equipment by the Users, for causes beyond the control of SegurCaixa Adeslas that prevent or delay the provision of services or browsing on the Website; nor for any (ii) delays and blockages caused by deficiencies or overloads of the Internet or in other electronic systems, nor for (iii) the impossibility of providing the service or granting access for causes not attributable to SegurCaixa Adeslas.

SegurCaixa Adeslas does not supervise the use that Users make of the Website, of the Customer Private Area or the App or of the data transmitted or stored by them. Nor does it perform active searches of facts or circumstances that indicate illegal activities. Therefore, it shall not be liable for such use.

SegurCaixa shall not be liable either for damage or losses of any type that may arise from the availability and technical continuity of the functioning of the Website. SegurCaixa Adeslas shall strive to reestablish the services as quickly as possible in the event of a technical fault.

SegurCaixa Adeslas reserves the right to temporarily suspend access to its Website, Customer Private Area or App for technical or maintenance reasons, without any type of compensation, although it undertakes to limit this type of interruption to the minimum time possible.

 

7. Intellectual property

SegurCaixa Adeslas declares and guarantees that it is the exclusive holder or, where appropriate, that it owns sufficient title to operate all the intellectual, industrial or similar property rights on the Website, the App and its contents, regardless of their form of expression (graphic design and codes, written information, drawings, image and sound files, distinctive signs, domain names, etc.).

At no time, unless with the prior written consent of its holders, does the access or use of the Website, App or its contents grant the User any entitlement over the aforementioned rights. Any undue use of such items by a person other than the legitimate holder may be pursued in accordance with the prevailing legislation. In any case, the User will abstain from deleting, altering, eluding or manipulating any security measures or symbols or indications to reserve rights with respect to the Website, App or its content.

The User may only make private and personal use of the contents of the Website, Customer Private Area or App. And it may not, under any circumstances, establish links between any space accessible from the Internet and such items. 

 

8. Links

If links are included to other applications or external websites not related to the Services,  SegurCaixa Adeslas is not liable for the contents of these applications or websites. Access to third-party services shall be the responsibility of the User, who must be governed by the terms and conditions of use of the pages consulted.

Furthermore, SegurCaixa Adeslas advises that the presence of links not belonging to the SegurCaixa Adeslas Group companies or not related with the Services have a merely informative purpose and, under no circumstances, do they represent a suggestion, invitation, sponsorship, backing or recommendation thereon by SegurCaixa Adeslas.

SegurCaixa Adeslas advises that the use by the User of the Website, Customer Private Area or App of the information contained therein are their own responsibility. And it does not guarantee that during access to other applications or websites through said links that it can avoid information that harms their sensitivity or causes damage.

Remember that if access to third-party services is provided from the Website, such services will be supplied by companies outside of SegurCaixa Adeslas. And that such third parties must provide information on the services provided to it and the personal data processing involved.

 

9. Update and amendment

SegurCaixa Adeslas reserves the right to update, modify, amplify or eliminate the information, contents and Services offered through the Website, Customer Private Area or App at any time, including access to third-party services. 

Likewise, it reserves the right to amend these Terms and Conditions at any time, so it is recommended to the User that they review them with reasonable frequency.

 

10. Security

Notifications made via the Website are posted using media that guarantee confidentiality and security. SegurCaixa Adeslas uses the Microsoft 365 SaaS solution to send and receive emails, which guarantees both the encryption in transit of the information and in sleep mode. Also, use of Proofpoint is made to analyse the emails and identify and block potentially malicious content.

All notices made by the App and the Widget Web are made using the SSL (Secure Sockets Layer) protocol, signed with the certificate obtained from an authorised certifying entity. SegurCaixa Adeslas undertakes, applying encryption and pseudonymisation techniques, to maintain and save the personal data that the Users provide to us in a confidential manner, guaranteeing their security and avoiding access by unauthorised third parties. SegurCaixa Adeslas strives to adopt all the means necessary to guarantee the data protection of its Users, and it undertakes to review and update them in accordance with the prevailing laws and technological advances.

 

11. Claims

For any claim related to the use of the Website, please get in touch with SegurCaixa Adeslas’s Customer Services department through the channels indicated in the “Contact” section published at www.segurcaixaadeslas.es/en/help/contact.

 

12. Applicable legislation and jurisdiction

These Terms and Conditions are drafted in Spanish and will be governed by Spanish legislation. Unless any legal provisions exist otherwise, the Courts and Tribunals of the city of Madrid (Spain) will be competent to settle any dispute on the interpretation or execution of these Terms and Conditions.

 

ANNEX

Information on the loyalty-building programmes currently under way

I. HEALTH PROGRAMME

Below we provide you with information that you must know and accept before you commence your registration process in the programme. We recommend that you read it carefully before beginning your registration process. 

 

1. Registration in the My health programme

The My health programme is offered by SegurCaixa Adeslas and is earmarked to all those people, of legal age, that are beneficiaries (insured parties) of a healthcare insurance policy and that make use of SegurCaixa Adeslas’s digital health services or that are Users of the Adeslas Salud y Bienestar mobile application and that voluntarily register therein, hereinafter the “User” or the “Users”. Participation in the programme is free of charge.

To register you must accept participation in My health, accessing this information and accepting it through the programme acceptance clause. Participation is personal and not transferable to other participants or third parties and is subject to these conditions, which you can consult, at any time, through the side menu of the Website or the App.

Only individuals will be allowed to participate, not allowing legal entities to take part. 

Participation will be limited to an account/User per person. For the purposes of the My health programme, repetitive registrations or downloads from different platforms or using different email addresses will not be taken into account when the holder is the same individual. Remember that it is not possible either to share or transfer your points to other Users.

The employees of SegurCaixa Adeslas and of its subsidiaries have the possibility of subscribing, but we reserve the right to limit their participation in certain promotions, establish specific conditions or of limiting such participation temporarily or definitively

 

2. How to obtains points and enjoy advantages

You can obtain points easily by carrying out the following actions on the SegurCaixa Adeslas Website and App:

  • Complete your health profile
  • Register and monitor your virtual health plans
  • Activate challenges and attain daily targets
  • Register and monitor the accompaniment programme

The points obtained for your participation can be exchanged for different products or services that are available at all times and can be consulted at saludybienestar.segurcaixaadeslas.es/mi-salud/puntos.

Furthermore, you must take into account that, under no circumstances, can the points be exchanged for cash or currency of any other type. SegurCaixa Adeslas reserves the right to modify, substitute or eliminate the gifts available at any time. 

 

3. Modification, cessation or elimination of the My health programme

As a User, you can deregister from the programme at any time. All you need to do is access your profile and select the “Deactivate” option from the “Healthcare services” section. Deregistration from the programme will lead to the loss of the points accumulated up to the deregistration date. 

The programme participation details will be deleted, as will all your activity records.

We reserve the right to modify, limit or suspend the My health programme, the applicable conditions, the services offered or the exchangeable gifts, and to finalise the programme at any time without the obligation to compensate the User. For such purposes, the User must consult, whenever they can, the updated version of the conditions applicable to the My health programme available in the side menu of the SegurCaixa Adeslas Website and App.

SegurCaixa Adeslas does not guarantee or assume any obligation to maintain the programme at long term or on an indefinite basis, hence the Users recognise that their participation does not involve an acquired right nor gives them the right to demand that the programme be maintained or to make a claim vis-à-vis SegurCaixa. 

SegurCaixa Adeslas may automatically cancel the subscription of any User from the programme in the event of attempted fraud, stolen information, supply of incorrect data, breach of the participation conditions or any act contrary to the Law, to public order or to good habits. 

 

4. Responsibility

As a User, you are responsible for all activity conducted through your own member account. This means that you are also responsible for conserving your access details, such as your email address and password, in a secure confidential manner, and for not sharing such details with third parties. If for any reason your access details are compromised, we recommend that you immediately modify your passwords and that you contact us if you require help. You can find information on how to contact us in the Help centre section, which you will find in the side menu of your Website or App. 

SegurCaixa Adeslas shall not be liable for any damage and losses that may arise from the interference, omissions, interruptions, IT viruses, breakdowns and/or disconnections in the operating functioning of this electronic system or in the apparatuses or IT equipment of the Users, originating from causes beyond SegurCaixa Adeslas’s control, which prevent or delay the use of the programme, or for delays or blockages in use, caused by deficiencies or overloads of the Internet or in other electronic systems, nor for (iii) the impossibility of providing the service or granting access for causes not attributable to SegurCaixa Adeslas, or for events beyond its control and, under no circumstances, shall SegurCaixa Adeslas be liable for the damage and losses of any type arising from said events.
